Installment Payment Method / Authorization for Payment
The Buyer hereby authorizes the company or its agents and/or assigns to electronically deduct/process on or after the due date for each consecutive billing cycle tuition payments directly from the following bank or credit/debit card accounts according to the terms of this agreement and to resubmit returned/declined items without prior notice. This payment information will be used to collect any balances past due according to the terms.
Consumer Right to Cancellation
Membership Agreement can be canceled at any given time. Once payment has come out for any given month/year and you submit cancellation after that, there is no refund, but you are welcome to participate in classes until your next payment cycle.
Terms and Conditions of Membership
1. WAIVER & RELEASE: You, parent and/or student, agree that you are aware that the student is engaging in physical activity/martial arts, and the use of equipment, training, and instruction, which can be dangerous and cause injury to your child or yourself. The student is voluntarily participating in these activities, and parent and/or student assume all risk of injury to the student, which may result. Parent and/or student hereby waive and release any claim or right to sue the studio and personnel, for injury to the student, which may result. Parent and/or student will indemnify and hold Beyond Martial Arts and all Martial Arts personnel harmless from any loss, liability, damage, cost or expense, including litigation, arising out of or connected in any way with student’s participation in said Martial Arts Program. Parent and/or student have carefully read this waiver and release, and fully understand it is a release of liability and damage of the studio for any injury. Beyond Martial Arts will make no evaluation or recommendation whether students or guests are sufficiently physically fit for exercise. It is always advisable to consult a physician before undertaking a physical exercise program. The studio does not assume any responsibility for the loss, damage, or theft, of any property belonging to you or the student. Parent and/or student agree that the studio and its personnel are not responsible for or liable for any such property even if loss, theft, or damage occurs in or about the Beyond Martial Arts facility.
2. 911 EMERGENCY RELEASE: I hereby give consent to Beyond Martial Arts to call 911 in the event of an emergency. I hereby give my consent to any emergency facility and physician to administer necessary treatment to my child in the event of an emergency at which time I cannot be reached. I give my consent to transport by ambulance if the situation warrants. Beyond Martial Arts provides no medical insurance for treatment of illness or injury and that any cost of treatment will be at my expense. I hereby release, discharge and absolve Beyond Martial Arts and Beyond Martial Arts personnel from and against all liability, injury, or damage arising out of or connected with the use of such medical services.
3. PHOTO & VIDEO: By entering this agreement, the undersigned grants the school permission to photograph or videotape any and or all activities, and use photographs, videotapes, artwork or other likenesses of the students or parents for marketing, trade, publishing or any other lawful purpose. All photos & Videotapes, including photos and videotapes submitted by members, will remain the sole & executive property of Beyond Martial Arts.
4. CLASSES: Scheduling and content of classes and programs and furnishing of facilities and instructors are at the sole and absolute discretion of the Seller and may be changed at any time by Seller without notice. Seller will provide instructors to teach and supervise classes, practice sessions, and contests conducted by the Seller. Buyer understands that during the course of instruction, Seller instructors, authorized personnel and/or other Buyers will be engaged in a course of conduct requiring physical contact with the Buyer. Buyer (and/or on behalf of Member, if a minor) hereby consents to engage in such contact as may be necessary or required by Buyer's (and/or on behalf of Member, if a minor) participation in the training program and/or classes.
5. MEDICAL DISABILITY: By written notice to Seller, the Buyer may extend the term of the membership at no additional cost for a period equal to the duration of the buyer's short-term disability, verified in writing by a licensed medical doctor.
6. PAYMENT PROCESSING: Buyer acknowledges that Seller utilizes the services of a third-party payment processing collection company, balance will be reported to the credit bureau. Seller's liability for any payments wrongfully processed or collected shall be solely limited to such wrongful amount, and to the extent, Buyer suffers damages in excess of such amount, whether bank charges, attorney's fees or other costs or expenses, Buyer agrees to hold harmless and indemnify Seller from same. Approved refunds shall be paid with 20 days after receipt of the notice of such a wrongful charge collected by Seller. The buyer also agrees not to back charge any transactions to their credit/debit card company.
7. Beyond Martial Arts reserves the right to terminate any membership for any reason without notice. Beyond Martial Arts reserves the right to cancel or refuse service at any point for any reason.
8. In the case of a minor Participant, the Undersigned parent or legal guardian acknowledges that he/she is not only signing this Agreement on his/her behalf but that he/she is also signing on behalf of the minor and that the minor shall be bound by all the terms of this Agreement. Additionally, by signing this Agreement as the parent or legal guardian of a minor Participant, the parent or legal guardian understands that he/she is also waiving certain rights on behalf of the minor otherwise may have. The Undersigned parent or legal guardian agrees that but for the foregoing, the minor Participant would not be permitted to participate in the Activity.
